Terms and Conditions
Please read these Terms and Conditions (“Agreement”) carefully. This Agreement is legally binding between Free Government Phones (“we,” “our,” or “us”) and you, the customer. By enrolling in the Affordable Connectivity Program (“ACP”) through Free Government Phones, using our ACP-supported services, or making changes to your account, you agree to these Terms.
We may update this Agreement at any time. Updated versions will be posted at freephonesgovernment.com and are effective once published. Continued use of our services after changes means you accept the revised terms.
1. Program Overview
The ACP is a federal benefit program managed by the FCC and USAC to make broadband more affordable for eligible households.
- Provides up to $30/month discount on internet service (up to $75/month on Tribal lands).
- Eligible households may also receive a one-time device discount of up to $100 toward a laptop, tablet, or desktop (customer must contribute $10–$50).
- Only one ACP service discount and one device discount are allowed per household.
- ACP benefits can be transferred to another participating provider if requested.
- Discounts are available only while funding continues and the household remains eligible.
2. Consent to Share Information
By applying for ACP service with Free Government Phones, you consent to the collection, use, and sharing of your information for the purposes of verifying eligibility and enrolling in the program. This may include:
- Full legal name, residential address, and date of birth.
- Last four digits of your Social Security Number or other ID.
- Proof of participation in qualifying assistance programs.
- Details related to your ACP benefits, usage status, and device distribution.
This information may be shared with USAC, FCC, and other authorized entities as required by law to administer the ACP. Refusal to provide consent may result in denial of benefits.
3. Eligibility
Households qualify if one member meets any of the following:
- Household income at or below 200% of Federal Poverty Guidelines.
- Participation in programs such as SNAP/EBT, Medicaid, SSI, Federal Public Housing Assistance, Veterans Pension, WIC, or School Lunch/Breakfast Program.
- Receipt of a Federal Pell Grant in the current award year.
- Meets a participating provider’s low-income eligibility rules.
Tribal households may also qualify through:
- Bureau of Indian Affairs General Assistance.
- Tribal TANF.
- Head Start (income-based).
- Food Distribution Program on Indian Reservations.
Eligibility is verified through the National Verifier managed by USAC.
4. Application & Service
- Approved applicants receive a SIM card for use with a compatible device.
- If eligible, you may also qualify for a one-time connected device discount.
- Only one ACP benefit per household/economic unit is allowed.
5. Benefit Transfers
If you are already receiving ACP benefits with another provider, enrolling with Free Government Phones means your benefit will be transferred. ACP rules allow one benefit transfer per month (exceptions apply if the transfer was unauthorized).
6. Lifeline + ACP
Households may combine ACP with Lifeline or keep them separate. You are not required to enroll in ACP to keep your Lifeline service.
7. Program Availability
ACP benefits depend on federal funding. If funding ends, Free Government Phones will notify customers (typically with 30 days’ notice). At that time, customers may continue service at standard rates if desired.
8. Usage & Account Requirements
- To keep ACP service active, you must use your service at least once every 30 days (call, text, or data usage).
- Service may be discontinued if eligibility cannot be verified or if required usage activity is not met.
- Benefits are non-transferable and cannot be sold or shared.
9. Annual Recertification
All ACP participants must recertify eligibility each year through the National Verifier. Failure to recertify will result in de-enrollment from the program.
10. Rates & Plans
- ACP discounts may be applied to any eligible Free Government Phones service plan.
- Plan features (minutes, texts, data) may vary by state and will be described on our website.
- Service fees and unused balances are non-refundable.
11. Termination
We may suspend or terminate service if:
- You no longer meet ACP eligibility.
- Fraud, misuse, or misrepresentation is suspected.
- You attempt to resell or transfer benefits.
You may cancel ACP service at any time, but monthly service fees and equipment costs are non-refundable.
12. Arbitration & Dispute Resolution
Certain disputes may be resolved through binding arbitration rather than a court trial. By using our services, you agree to resolve disputes through arbitration where required.
